Welcome to Cafe Fuel. These Terms and Conditions ("Terms") govern your use of https://fueljxn.com (the "Site"), our text messaging program, and any related services we provide (collectively, the "Services"). Cafe Fuel is operated by Lean Rocket Lab, a Michigan nonprofit corporation ("we," "us," or "our").

By using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services. By using the Services, you represent that you meet this requirement.

2. About Cafe Fuel

Cafe Fuel is a cafe operated by Lean Rocket Lab in Jackson, Michigan. Through the Site and our chat widget, we provide information about our menu, hours, events, and ways to contact us.

3. Use of the Site

You agree to use the Site only for lawful purposes and in compliance with these Terms. You agree not to:

• Use the Site in any way that violates applicable law or regulation

• Impersonate any person or entity, or misrepresent your affiliation with any person or entity

• Interfere with or disrupt the Site or its servers

• Use automated means (bots, scrapers) to access the Site without our prior written permission

• Attempt to gain unauthorized access to any portion of the Site or any related systems

 

4. SMS / Text Messaging Program

By providing your mobile phone number and opting in to receive text messages from Cafe Fuel, you agree to the following terms.

Program description. The Cafe Fuel SMS program sends recurring informational, transactional, and/or promotional text messages, depending on the consent you provide. Messages may include order confirmations, pickup notifications, customer service replies, promotions, events, and similar updates.

Frequency. Message frequency varies based on your activity. Promotional messages may be sent up to 4 times per month.

Message and data rates. Standard message and data rates may apply to each message sent or received, depending on your mobile carrier and plan.

Opt-out. Text STOP to any message to unsubscribe. You will receive a confirmation message and will not receive further messages unless you opt back in.

Supported carriers. AT&T, Verizon Wireless, T-Mobile, U.S. Cellular, Boost, Cricket, MetroPCS, and other major U.S. carriers. Carriers are not liable for delayed or undelivered messages.

Eligibility. You must be the mobile account holder or have the account holder's permission to enroll the mobile number you provide.

Privacy. Our handling of mobile information is governed by our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

Consent is not a condition of purchase. You are not required to consent to receive text messages to purchase any goods or services from Cafe Fuel.

 

5. Intellectual Property

All content on the Site — including text, graphics, logos, images, and software — is the property of Cafe Fuel, Lean Rocket Lab, or our licensors and is protected by U.S. and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.

 

6. User Content

If you submit content to us through the Site or chat widget (messages, feedback, reviews), you grant Cafe Fuel a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with operating our Services. You represent that you have the right to grant this license and that your content does not infringe on the rights of any third party.

The Site may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of those sites. Your interactions with third parties are governed by their terms and policies, not ours.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, CAFE FUEL DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.

 

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CAFE FUEL, LEAN ROCKET LAB, AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES SHALL NOT EXCEED ONE HUNDRED DOLLARS (USD $100.00).

 

10. Indemnification

You agree to indemnify and hold harmless Cafe Fuel, Lean Rocket Lab, and their affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, or expenses (including reasonable attorneys' fees) arising from your use of the Services or your violation of these Terms.

 

11. Governing Law and Venue

These Terms are governed by the laws of the State of Michigan, without regard to its conflict of laws principles. Any disputes arising out of or related to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Jackson County, Michigan, and you consent to the jurisdiction of those courts.

 

12. Changes to These Terms

We may update these Terms from time to time. The "Effective Date" at the top reflects the most recent version. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

 

13. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect.
